The principle of minimization applies: only the part where the customer gives their consent should be recorded. The rest of the exchange (preliminary questions, hesitations, side discussions) is not intended to be retained as contractual evidence.  <\/p>\n\n<p class=\"wp-block-paragraph\">What about information? The caller must be informed, before the recording begins, that the call is being recorded and why. The caller must also be informed of the alternatives: Can the contract be concluded in person at a branch, online, or by mail? The <strong>law on the recording of telephone conversations<\/strong> requires this transparency. The principle is crystal clear.<strong>According to the CNIL, telephone recording<\/strong> must remain proportionate to the intended purpose. If you\u2019re recording for quality control, a sample of calls is sufficient. If you\u2019re recording for training purposes, a few targeted calls per month will suffice.    <\/p>\n\n<p class=\"wp-block-paragraph\">Recording 100% of the video feed amounts to placing your employees under constant surveillance, which disproportionately infringes on their privacy. The CNIL has reiterated this position on several occasions: the <strong>purpose of the data processing<\/strong> never justifies a system that captures everything when sampling achieves the same result. <\/p>\n\n<p class=\"wp-block-paragraph\">There are exceptions, but they are strictly regulated. The financial sector (MiFID II, as mentioned earlier) requires the systematic recording of conversations related to trade orders. Emergency call centers (15, 17, 18) are required by regulation to record calls. Outside of these cases, the rule remains<strong>the proportionality test<\/strong>: record only what is strictly necessary, and nothing more.   <\/p>\n\n<p class=\"wp-block-paragraph\">For a traditional call center, what does this mean in practice? No \u201cjust in case\u201d storage, no unlimited archiving for convenience. Once the purpose has been fulfilled, the audio file must be deleted or anonymized.  <\/p>\n\n<p class=\"wp-block-paragraph\">In practice, the durations vary depending on the use:<\/p>\n\n<ul class=\"wp-block-list\">\n<li><strong>Quality control and training<\/strong>: The CNIL recommends retaining recordings for a maximum of 6 months. Beyond that, the recording no longer has any operational value for coaching or evaluating an employee. <\/li>\n\n\n\n<li><strong>Evidence of the formation of a contract<\/strong>: the time limit corresponds to the applicable statutory limitation period. Under civil law, this is 5 years (Article 2224 of the Civil Code). In certain regulated sectors, it can also be up to 5 years, or even longer if required by sector-specific regulations.  <\/li>\n\n\n\n<li><strong>Sector-specific legal requirement<\/strong> (e.g., MiFID II): The retention period is specified in the regulation itself, generally 5 years for financial transactions.<\/li>\n<\/ul>\n\n<p class=\"wp-block-paragraph\">The most common pitfall is failing to automate data deletion.
